| Descripción : | This work is grounded on the research of the effects of the implementation of the Social Economy of Knowledge, Creativity and Innovation Code, or INGENIOS Code in the workplace of ecuadorian artists. Same that replaces the Intellectual Property Law. The main objective was to determine what characteristics and implications has the regulation of copyright and intellectual property for musicians, filmmakers and audiovisual producers of Ecuador. Musicians, artists, poets, writers, filmmakers, audiovisual producers, sound producers and software developers were interviewed. As well as to intellectual property and copyrights specialized lawyers. These interviews made it possible to know the flaws within the law of intellectual property and the code. It tackled issues of contracts, royalties, incentives for creativity and professional development. Also, this work included a comparison of the legal regulations between the INGENIOS code and Intellectual Property Law. On the legal issue, a lawyer from the SENESCYT was consulted to know the reason for the change and the legal situation of Ecuadorian authors and artists. This information was used to deepen in the principal theme: economics rights over the works of Ecuadorian authors. On the other hand, this interview clarified that even though piracy is an important issue in this research and within the rules of the INGENIOS Code is a problem without regulation in the practice. Field research exposed the INGENIOS code covers 11 principles within five legal books, which contribute to encourage creation and innovation to improve the productive matrix. However, this research concluded that the INGENIOS code does not help artists or Ecuadorian authors. Despite regulations that help economically to the authors, with a payment of 10 por ciento, the country does not have cultural, educational or physical support to help the production that the law requires. |
