Descripción : Since the beginning of time, humans have fought for independence nonetheless; it is also true that human beings must live in community, for this reason the idea of society developed and evolved into what we have today. With the establishment of society the establishment of law became imperative, that is to say, a group of clearly defined laws to regulate this newly established society, enabling people to live in peace and harmony within it. Within law there are two main doctrines, the first one lus naturalismo that deals with the inherent principles, immutable to the person that stem from human nature; the second doctrine known as lus positivismo deals with norms and laws that are a part of a developmental process by which they are created, implemented and ultimately obeyed by the members of the society. From this doctrine derives the nature of law, to regulate human behavior through the means of judiciary norms. Rights (inherent to human beings) as well as norms (rules that stem from common sense) arise from the doctrine previously mentioned. The Constitution is the maximum norm in a country, out of which the rights and duties of the citizens are derived from. The Ecuadorian Constitution of 2008 recognized a right which is particularly popular within the lus naturalismo doctrine but in recent years it has been included as positive right, this is the right to resistance, as a means by which citizens may participate within government. This recognized norm within The Constitution has not been properly developed so that citizens may adequately utilize it and its mechanism for demand is almost void. In an attempt to correct this gap in the legislation an effective procedure for the invocation, recognition and ultimate practice of the norm of resistance has been planned. The proposed mechanism is in agreement with actual laws within the Ecuadorian law system
