Resumen : La responsabilidad penal dada en función de la actual normativa vigente con respecto a la trata de personas no mantiene una efectiva relación con la magnitud del hecho y las afecciones que produce a la víctima. Si bien es cierto, las sanciones tienden a endurecerse con la aprobación del Código Orgánico Integral Penal, estas acorde a los estudios realzados son necesarias, pero no suficientes. La presente investigación, ha cumplido con un análisis exegético y comparativo referente a este delito, permitiendo mejorar la comprensión sobre el mismo, determinando las causas que lo provocan, así como también las afecciones. El estudio permitió concluir que su tipificación es compleja, presentándose múltiples formas en que se afecta a la víctima, representando una clara forma de esclavitud del Siglo XXI. Uno de los aspectos de mayor gravedad es que el delito se comete generalmente a cargo de organizaciones criminales que operan a nivel nacional e internacional, las cuales aprovechan los avances científicos y tecnológicos existentes para planificar sus actividades, situación que produce riesgos aún mayores. Ecuador según las estadísticas vigentes es un país originario, es decir en donde se buscan las víctimas, mostrando mayor vulnerabilidad en la población de género femenino, menor de edades y refugiados. Por otra parte, en el ámbito jurídico es clara la necesidad de un derecho integrador que dé lugar a acciones en conjunto con diversas organizaciones y países para alcanzar soluciones viables y pertinentes. Para disponer de una visión más amplia se procedió a analizar el marco legal de Argentina y Colombia, países los cuales permitieron tener una importante visión en los ámbitos de la prevención, la asistencia y protección a las víctimas y principalmente la responsabilidad penal. El estudio presentó un proyecto de ley el cual amerita revisarse, mismo que busca perfeccionar las normativas en base a este delito, permitiendo evitar y erradicarlo.
Descripción : Regarding human trafficking, criminal responsibility as provided in the law, does not respond effectively to the relationship between the magnitude of the acts and the consequences suffered by the victim. While sanctions tend to become harder with the approval of the Integral Criminal Organic Code (Código Orgánico Integral Penal), according to recent investigations, these sanctions are not enough. This investigation has complied with an exegetic and comparative analysis regarding human trafficking, allowing a better understanding of this crime while establishing the causes that create a proclivity towards this crime and its impacts on the victim. Through this analysis, it was possible to conclude that the criminalization of human trafficking is complex. There are several ways in which the victim is affected. This crime represents how slavery remains in the 21 century. A serious aspect of this crime surrounds around the fact that it is committed by criminal organizations working nationally and internationally. These groups take advantage of any scientific and technologic development to plan and execute their criminal activities. This increases the risk of this crime being committed. According to the latest statistics, Ecuador is a “country of origin” this means that victims are sought for in Ecuador. Statistics shows a greater level of vulnerability in the female underage population and refugees are also considered an easy target. Regarding the judicial aspect of this issue, it is clear that there is huge necessity for inclusive and comprehensive regulations. This could allow the coordination and cooperation between several organizations and countries, while reaching viable and relevant solutions. In order to grant a broader view, a legal analysis of the regulations of Argentina and Colombia was made. These regulations provided important information regarding prevention, assistance and protection of the victims and regarding criminal responsibility. As a consequence of this study, a project of a bill has been included. It is important to review this project since it aims to improve the regulations ruling this crime, trying to avoid and eradicate it.
