Resumen : Esta investigación trata de la relevancia que tiene el dotarle de un adecuado grado de legitimidad e independencia a la Corte Constitucional, resaltando la importancia de los métodos de selección de los jueces constitucionales para asegurar su independencia y, a través de esta, garantizar el Estado Constitucional de derechos y justicia. Para ello, se analiza como el método de selección influye en la independencia de dichos jueces y de la Corte Constitucional, que es el máximo órgano de control constitucional y guardiana de la Constitución. Se abordan variados sistemas de selección, con el fin de analizar el sistema de elección en el caso ecuatoriano; para finalmente, plantear una propuesta alternativa para la selección y designación de los jueces que conforman la Corte Constitucional, con la finalidad de mejorar el sistema, a partir de la opinión de tratadistas, experiencia en el plano nacional e internacional, en la búsqueda de la ansiada legitimidad, autonomía e independencia de este organismo.
Descripción : This research goes around the relevance of provide to the Constitutional Court an adequate degree of legitimacy and independence highlighting the importance of the selection methods of constitutional judges to ensure their independence and, through this, ensure the Constitutional State rights and Justice. For this purpose is analyzed how the method of selection affects the independence of the judges of the Constitutional Court, which is the highest constitutional control organism and guardian of the Constitution, and then different selection systems are presented, in order to analyze the selection system in the Ecuadorian reality to finally lay out an alternative proposal for the selection and appointment of judges that are going to form the Constitutional Court in order to improve the system, from the opinion of writers, experience at the national level and internationally, giving rise to several criteria that can be implemented in pursuit of the coveted legitimacy, autonomy and independence of this organism.
