| Descripción : | The present research work has as a principal objective to propose the incorporation of the figure of the shared possession in the Ecuadorian legislation, for which it has been divided into four chapters. The first of them studies the distinguishing elements of the possession and parental authority, as well as the figures that take part on them, which is how we conceptualize both legal figures. Next , the second chapter exposes the managed criteria handled by countries like: France, Italy, Colombia and Sweden, in respect to the shared possession, in addition there is a revision of the norms contained in the Convention of children rights, The Ecuadorian Constitution and The Childhood and Adolescence Code with the purpose of providing more buoyancy to the presented initiative, nevertheless this fundamentally permits to observe that the Ecuadorian Normative Reference possesses the required social and legal conditions to include the figure of the shared possession in its legal system |
