| dc.description | The juvenile offenders are those who with more than 12 years and with less than 18 years have responsibility that has been determined as the author or participant of a punishable act typified as a crime or offense in the criminal law. The trial process and the rehabilitation system of a minor are different from those of an individual who exceeds the majority of age. Therefore, Ecuadorian justice must make its mechanisms effective to provide the best and most useful attention; this group must be a priority within the penitentiary system of Ecuador. This research proposes to show what the current situation of juvenile offenders is in Quito is. It will be shown to those who participate in the legal process to judge the minor and subsequently to those who participate in their rehabilitation to achieve the reintegration of them to society. Also, the information obtained in the interviews will be contextualized with the previous research published in the preliminary draft. Likewise, cases of juveniles who have been tried and subsequently submitted to detention at the Virgilio Guerrero Center for Offenders will also be announced; and some others that have received sanctions such as socio educational and community support. Finally, some of the findings and conclusions of the investigation will be expressed as the lack of training and differentiation between the common criminal justice and juvenile justice. | en |
| dc.description.abstract | Los adolescentes infractores son aquellos que con más de 12 años y con menos de 18 años tienen responsabilidad que ha sido determinada como autor o partícipe de un hecho punible tipificado como delito o falta en la ley penal. El proceso de juzgamiento y el sistema de rehabilitación de un menor de edad son distintos a los de un individuo que sobrepasa la mayoría de edad. Por tanto, la justicia ecuatoriana debe efectivizar sus mecanismos para brindar la mejor y más útil atención; este grupo debe ser prioridad dentro del sistema penitenciario del Ecuador. Esta investigación evidencia cuál es la situación actual de los adolescentes infractores en Quito. Se muestra a quienes participan del proceso legal para juzgar al menor de edad y posteriormente a quienes participan de su rehabilitación para lograr la reinserción de este a la sociedad. También, se contextualiza el tema mediante la información obtenida en las entrevistas y la investigación previa publicada en el anteproyecto. Asimismo, se da a conocer casos de adolescentes que han sido juzgados y posteriormente sometidos a internamiento en el Centro de Adolescentes Infractores Virgilio Guerrero; otros que han recibido sanciones como la socioeducativa y el apoyo comunitario. Finalmente, se describen algunos de los hallazgos y conclusiones de la investigación como la falta de capacitación y diferenciación entre la justicia penal común y la justicia juvenil. | es_ES |
