Resumen : | A través del presente estudio académico, se buscará realizar un análisis del alcance, los efectos y la forma en la que el derecho a la reparación integral ha sido concebido en el Ecuador, dentro del nuevo paradigma garantista que se ha instituido con la promulgación de la Constitución de Montecristi en el año 2008. De igual forma, se analizará como este derecho se ha venido desarrollando en las acciones extraordinarias de protección aceptadas por la Corte Constitucional en sentencias penales. Se han tomado las sentencias penales, a efectos del presente análisis, en razón de que se restringe la libertad personal del imputado. En este sentido, la reparación integral se erige como un medio de resarcimiento aún más importante, cuando se han violentado los derechos fundamentales del sancionado y éste por los efectos de la sentencia ha perdido en efecto su libertad, generando graves consecuencias socio familiares para el agredido. Por ende, a través del presente estudio y del análisis de sentencias emanadas por la Corte Constitucional, se buscará esclarecer si los medios de reparación integral que ha utilizado la Corte han sido satisfactorios y han reparado de manera íntegra a las víctimas de violaciones de derechos constitucionales en los fallos de la justicia ordinaria. |
Descripción : | Through the present academic study, an analysis will be made of the scope, effects and manner, in which the right to integral reparation has been conceived in Ecuador, within the new state paradigm, which has been instituted with the promulgation of the Constitution of Montecristi in 2008. In the same way, it will be analyzed how this right has been developed through those extraordinary protection actions accepted by the Constitutional Court in criminal sentences. Penal sentences have been taken, for the purposes of the present analysis, on the grounds that personal freedom of the accused is restricted. In this sense, integral reparation stands as even more important means of redress, when the fundamental rights of the sanctioned have been violated and, due to the effects of the sentence, have in effect lost their freedom, generating serious sociofamily consequences for the assaulted Therefore, through the present study and the analysis of judgments issued by the Constitutional Court, it will be sought to clarify whether the means of integral reparation used by the court have been satisfactory and have fully repaired the victims of human rights violations in the decisions of the ordinary courts. |
