Resumen : El presente trabajo investigativo tiene por objeto responder a la siguiente pregunta ¿El trámite de acción privada otorga tutela judicial efectiva en el delito de lesiones? Para llegar a la consecución de este objetivo, se utilizó el método dogmático, exegético y analítico, que permitieron la obtención de datos, aportes e información precisa y concreta en relación al tema trazado, la misma que fue corroborada con la utilización de las técnicas de investigación, entre la que se encuentra la observación de la realidad que viven muchas víctimas de este tipo de delitos, cuyos daños no sólo le afecta en forma física sino que tiene graves secuelas a posteriori, pero además, se puede verificar que en muchos casos, este delito queda en la impunidad y sin reparación integral. Para demostrar la tesis planteada en concreto se analizan los siguientes aspectos: Comparación entre las facilidades del trámite de ejercicio público de la acción penal versus el de ejercicio privado de la acción penal, investigación de la Policía, medicina legal, el apoyo científico forense, la asesoría jurídica ofrecida tanto por la Fiscalía como por la Defensoría Pública, el aporte de las medidas cautelares que garantizan la comparecencia del imputado al juicio y la eficacia del proceso e incluso datos oficiales del Consejo de la Judicatura demuestran la diferencia marcada entre las distintas acciones penales.
Descripción : The current work studied, has as an objective to answer the following question ¿The process of private action grant effective judicial protection in the crime of injuries? To reach the answer of this objective, the dogmatic, exegetical and analytic, that allowed the obtainment of data, contributions of precise and concrete information in relation to the presented theme, the same that was implemented with the utilization of the techniques of investigation, including the observation of the reality of life of many victims of this type of crime, whose injuries and trauma are not limited to merely the physical but suffer serious a posteriori, but it can also be verified that in many of these cases, this crime goes without punishment and without any integral reparation. To demonstrate the planted thesis in concrete terms, the following aspects are analyzed: Comparison between these facilities of the process of public exercise of the criminal action versus of the private exercise of the criminal action, investigation of the Police, legal medicine, the support of the forensic scientist, the legal assessment offered by the Attorney General of the State as well by the Public Defender and the contributions of precautionary measures the guarantee the appearance of the accused in court and of the efficacy of the process including official data from the Council of the Judicature demonstrated the marked difference between the different penal actions.
