| Descripción : | The Inter- American System for the protection of Human Rights became stronger through the solidification of general and customary rules and principles of International Law, nevertheless, it results highly complex to apply the criteria of admissibility in order to access to the mentioned system, since it corresponds to analyze each particular case to be able to determinate which resources must be exhausted. In2008, Ecuador adopted a new Constitution, that established some Constitutional remedies that aim to ensure and protect the rights that are recognized by the Constitution and the International Treaties, and provide adequate repair measures. This titling essay, aims to study the nature and purpose of the extraordinary protection action, enshrined in the 2008 Constitution, in order to determine if it can be considered an ordinary remedy that must be exhausted before filing a petition before de IASPHR. In particular, the adequacy and effectiveness of the action will be analyzed, under the standards that the Inter- American Court of Human Rights has stablished in its jurisprudence. |
