Resumen : El presente trabajo tiene como finalidad responder la inquietud: ¿las reformas tributarias propuestas en la Ley Orgánica de Incentivos Tributarios para Varios Sectores Productivos e Interpretativa del Artículo 547 del Código Orgánico de Organización Territorial, Autonomía y Descentralización, son eficaces para lograr reactivar la economía del país? Para dar respuesta a esta pregunta se ha desarrollado en el primer capítulo la base teórica de los fines parafiscales de las leyes tributarias. Además, el análisis normativo de los incentivos propuestos para la reactivación de la economía en el Código Orgánico de la Producción, Comercio e Inversión, y en la Ley Orgánica de Incentivos para las Asociaciones Público-Privadas y la Inversión Extranjera. Este capítulo concluye con un análisis detallado de los resultados obtenidos por ambos cuerpos legales. En el segundo capítulo, se estudian los incentivos previstos en la Ley Orgánica de Incentivos Tributarios para Varios Sectores Productivos e Interpretativa del Artículo 547 del Código Orgánico de Organización Territorial, Autonomía y Descentralización. También se analiza el impacto que se espera que esta Ley tenga en la economía del país, como repercutirá en los sectores productivos beneficiarios y los efectos que tendrá en la reactivación de la economía nacional, respondiendo de este modo la interrogante inicial. Finalmente, se establecen conclusiones de los análisis realizados y recomendaciones.
Descripción : The purpose of this paper is to answer the following question: Are the tax reforms proposed in the Organic Law of Tax Incentives for Various Productive Sections and Interpretive of the Article 547 of the Organic Code of Territorial Organization, Autonomy and Decentralization, effective in reactivating the Ecuadorian economy? To answer this question, theoretical basis of the parafiscal purposes of tax laws has been developed in the first chapter. In addition, the normative analysis of the incentives proposed for the reactivation of the economy in the Organic Code of Production, Trade and Investment, and the Organic Law of Incentives for Public-Private Associations and Foreign Investment are developed. This chapter concludes with a detailed analysis of the results obtained by both. In the second chapter, the incentives provided in the Organic Law of Tax Incentives for Various Productive Sections and Interpretive of the Article 547 of the Organic Code of Territorial Organization, Autonomy and Decentralization are studied. It also analyzes the impact that this Law is expected to have on the economy of the country, how it will affect the beneficiary productive sectors and the effects that this will have on the reactivation of the national economy; answering the initial question. Finally, conclusions of the analysis developed in the research and recommendations are established.
