Descripción : The Ecuadorian Constitution of 2008, in the article 57, numeral 12, protects the right to recover, promote and protect the ritual and sacred places of indigenous peoples and communities, as collective rights. However, the State and companies, through extractive activities of nonrenewable natural resources, have intervened in the ancestral collective territory, considered as sacred. For this reason, the Amazonian community of Sarayaku has stated that the Kawsak Sacha as a notion of “sacred territory” must be recognized as implicit in the idea of Sumak Kawsay, which includes the protection of areas demarcated as sacred, as well as the spaces belonging to the Communities and indigenous peoples, to keep them free of industrial and extractive processes. This essay will discuss about how the Kawsak Sacha should be considered as a constitutional parameter that could prevent the State from exploiting natural resources in these areas, in order to promote the recognition of Kawsak Sacha as “Sacred Territory and Heritage of Biodiversity and Kichwa people”, urged by the Inter-American Court of Human Rights and on the recommendation of IUCN (International Union for Conservation of Nature), as a sacred area free of industrial activities.
