| Descripción : | Migration is as old a phenomenon as the history of mankind. Over the years, the rights of people in a situation of human mobility (understood in a broader sense than migration) have been recognized, since it has been determined that - because of their human quality (worth redundancy) - these people have the same rights as nationals in one State. However, even today, there are those who argue that even though these human rights are true even for migrants, the State has an obligation with its nationals, which translates into a "right" called sovereignty. This debate means that, to this day, the rights of migrants are not recognized; without taking into account that there is a multiplicity of factors and causes that surround the subject of mobility and that should at least limit the State and force it to decide case by case. But, in practice, the States continue to subscribe international treaties and conventions, and limit them to their minimum content. Ecuador, for example, determines the existence of universal citizenship, however, establishes procedures and limits for foreigners, putting at risk the full exercise of the right of free transit and other human rights involved, forgetting that these rights of migrants, are positive and negative obligations for the sending and receiving State, both involved in the migration process. Transportation, communication, information, among other advances immersed in the development of humanity, have made human mobility a phenomenon that has no brake and no limits. Hence the need to establish clear rules that allow the effective enjoyment of the rights of the inhabitants (no longer nationals) of a territory, as well as their obligations towards other people and the State. |
