Descripción : The test is intended to examine whether “criminal laws blank” against the environment and nature in the Code of Criminal Integral (hereinafter COIP) are or are not in conflict with the principle of legality. In this research, the first chapter, includes the definition of the principle of legality, with its respective fundaments and contents, and therefore, the consequences of this principle and fundamental axes, in order to see the possible lines of interpretation that this legal principle exist within the sources of law. The second chapter deals with the “blank criminal laws” providing the following aspects: definition and classification doctrinaire; also considered that through the fulfillment of certain legal requirements can be estimated effective the laws in question, and the case must contain the following requirements: accuracy essential core by the criminal law, remission of express rules, justification for remission on account of legally protected by criminal law. Since, as there is a legal vacuum in the criminal legislation, these laws would be used to supplement them. However, they can also interfere with the principle of legality, as with certain articles of the fourth chapter of COIP. In the third chapter, an analysis concerning “criminal laws blank” is made within crimes against the environment and nature or Pacha Mama and conflict that occurs with the principle of legality, so began the development through generalities about environmental crimes in the COIP, and ends determining the existence of laws in question with inference with the principle of legality. Finally, the last point of the work conclusions responding to the problems raised, in order to address the questions raised in the investigation were established.
