dc.descriptionThe executive trial is a running process that seeks the implementation or fulfillment of an obligation, since this process is not to declare rights but to execute them, it is for this reason that the debate within the executive trial is limited, since by its very nature, it can only be discussed exceptions of type of exchange rate as for example the lack of executive title, formal invalidity or falsehood of the title, the extinction of all or part of the obligation required, existence of self-calling to trial for the crime of usury or private enrichment not justified and previous derogations provided in the General Organic Code of Processes. Since it is possible to notice the juridical debate in the executive judgment is very limited, because by its nature only this type of exceptions can appear, so the vanquished in executive trial remain in a helplessness state and therefore their right to defense is being violated, and it is here when the regular trial before the executive trial takes importance, since in that one the debate is wider, because that is a process of full knowledge, which allows to discuss essentially the cause of the obligation, it is worth to say, the reason that led to the parties to the signing of the title, granting the executed that is deprived of exhausting all defensive means and to use every evidence in the executive trial due to its nature, the possibility of promoting a farther regular procedure of full knowledge, and it is there where lies the legal nature of the subsequent ordinary trial. In the light of the foregoing, it is clear that it is necessary that regular trial post executive trial to be incorporated in the General Organic Code of Processes.en
dc.description.abstractEl juicio ejecutivo es un proceso de ejecución que busca la efectivización o cumplimiento de una obligación, ya que este proceso no está para declarar derechos, sino para ejecutarlos. Es por esto que el debate dentro del juicio ejecutivo es limitado, pues, por su naturaleza solo se pueden discutir las excepciones cambiarias, como por ejemplo la falta de título ejecutivo, nulidad formal o falsedad del título, la extinción total o parcial de la obligación exigida, existencia de auto de llamamiento a juicio por delito de usura o enriquecimiento privado no justificado y las excepciones previas previstas en el Código Orgánico General de Procesos. Como se puede notar, el debate jurídico en el juicio ejecutivo es limitado, ya que por su naturaleza solo se pueden presentar excepciones referentes al título, por lo que el vencido en el juicio ejecutivo queda en estado de indefensión y por ende se está vulnerando su derecho constitucional a la defensa. Es aquí cuando toma importancia el juicio ordinario posterior al juicio ejecutivo, ya que en este el debate es más amplio, en razón de que es un proceso de conocimiento pleno, que permite discutir esencialmente la causa de la obligación, vale decir, la razón que motivó a las partes a la suscripción del título, otorgándole al ejecutado la posibilidad de agotar todos sus medios defensivos y de utilizar todas las pruebas que en el juicio ejecutivo no pudo debido a la naturaleza de este. Por lo expuesto, queda claro que es necesario que el juicio ordinario posterior al juicio ejecutivo sea incorporado al Código Orgánico General de Procesos.es_ES
