Descripción : In Ecuador, the issue of the decriminalization of abortion remains latent, and even in certain sectors, it is a taboo subject. Within the national legal system, abortion is only contemplated in cases in which the pregnancy could endanger the life or health of the mother, provided that this risk cannot be avoided by other means, and if pregnancy is a result of a violation, provided that it is the case of a woman who has a mental disability. It is not until recent decades that it is established within Ecuadorian society a debate on the right that women have to decide when and how many children to have. The aim of the following academic essay is the analysis on the implementation of the international instruments and treaties ratified by Ecuador in human rights -especially with regard to sexual and reproductive rights-, and its acceptance in the national legal system, in order to highlight the importance of the right to decide when and how many children to have, in connection with the personal female development. In this sense, we will also analyze the so-called block of constitutionality, according to which Ecuador joined other States of the region with regard to the progressive recognition of the international normative in matter of human rights, and by which it would be forced to decriminalize abortion, as while there are international principles and standards that are not written in the constitutional articles, they are about control parameters of constitutionality of the laws, and are of immediate to unrestricted application. Thus, the following academic essay aims to go over the national progress in the recognition of sexual and reproductive rights, and to highlight the necessity that a constitutional State and that guarantees the rights takes into account the outlawed by international instruments of human rights regarding the decriminalization of abortion, at least in the cases.
