| Descripción : | The Ecuadorian government has ventured within the worldwide phenomenon of cooperation between public and private sectors for the development of projects regarding some public services. This new perspective has radically changed the ideas regarding public procurement and demands reconsideration of certain constitutional principles that do not respond to the current position taken by the Ecuadorian government. This paper addresses the issue between the establishment of incentives for private investors in matter of dispute resolution and the defense of State sovereignty. We will approach these issues from the perspective of Public-Private Partnerships and the implementation of international arbitration in this mode Procurement. In order to do this, we will take into consideration doctrine, constitutional legislation in arbitration matters and jurisprudence of the Constitutional Court. |
