Resumen : | La prisión preventiva es la limitación a la libertad de las personas, uno de los derechos fundamentales del hombre, que se encuentra reconocido y garantizado por el Estado en el Art. 66, numeral 29, literal a., de la Constitución Política de la República del Ecuador. Quien sufre la prisión preventiva es considerado como un antisocial y un elemento negativo de la sociedad. Se ha utilizado de manera deliberada la prisión preventiva, como un mecanismo para frenar la ola delincuencial que azota a nuestro país, creyendo de esta manera, garantizar la paz y seguridad ciudadana. Si se utilizaría la prisión preventiva como una limitación a la libertad y como una medida cautelar excepcional, no tendríamos las cárceles llenas de ciudadanos, en unos casos que han delinquido y en otros que sin haber cometido delito algunos deben guardar prisión, por la orden de un Juez de Garantías Penales que resulta apresurada sin la correspondiente motivación… |
Descripción : | The protective custody is the restriction of people freedom, one of the main rights of men, which is recognized and guaranteed by the state in the Art. 66, number 29, paragraph a., of the political Constitution of the republic of Ecuador. A person who suffers protective custody is considered as an unhelpful and as a negative element of the society. Furthermore, the protective custody has been used as a deliberate way and as a mechanism to slow down the violence of our country in order to guarantee harmony and public safety. If the protective custody were used as a freedom restriction and as a precautionary measure, there were not many jails full of people that have committed a criminal offense and in some cases people who have not committed any kind of offence and are in jail. Our country has signed and ratified the American convention of the human rights that establish the personal right to the freedom. However, it has not been guaranteed in an effectively way and has been suspended for arbitrary detentions. |
