Resumen : La revictimización o victimización secundaria es un fenómeno manifestado notablemente dentro del sistema judicial. La participación de la víctima en el proceso penal, desde antaño ha cumplido con el rol de espectador, siendo sus intereses ajenos a los fines del proceso penal. No obstante con la contribución de la victimología se ha dado un paso trascendental en materia de víctimas a nivel internacional, intentando conceder a la víctima una perspectiva diferente dentro del sistema judicial penal. Las víctimas de manera general, sufren graves impactos psicológicos a causa del delito y particularmente las víctimas de violencia sexual, quienes padecen mayores efectos perjudiciales a causa del trauma por ser un hecho violento y estresante. La víctima al entrar en contacto con el sistema de justicia sin los resguardos necesarios puede provocarle consecuencias mayores que las causadas por el hecho delictivo, lo que significa ahondar en la afectación personal padecida. Al no brindar una asistencia y apoyo absoluto por parte de los operadores de justicia, acarrea una total negación de sus derechos. La concepción que se maneja respecto de la víctima en el sistema penal ecuatoriano no guarda equilibrio con las garantías que se prevén en la Constitución de la República del Ecuador, naturalmente se produce un choque entre las expectativas de la víctima y la realidad institucional. La forma más común de victimización secundaria es debido a, las múltiples y reiteradas ocasiones en que la víctima tiene que declarar. El objetivo de esta investigación es conceder una respuesta para determinar la modalidad de recepción del testimonio que se adecue a sus necesidades sin transgredir derechos del imputado, reformas concretas con nuevas formas procedimentales que velen por la intimidad y seguridad de la víctima. Implica, además, que los operadores del sistema penal optimicen los recursos que poseen a fin de establecer las vías para que la víctima de violencia sexual reciba un trato humanitario y digno que le brinde asistencia, atención y seguridad integral.
Descripción : Revictimization or secondary victimization is a phenomenon that has manifested notably in the judicial system. In previous years, the victims of participation in the criminal process fulfilled the role of being a spectator. As a consequence, the interests of victims have been foreign to those of the criminal process. However, the contribution of victimology has taken a bold step in the field of international victims, trying to give the victim a different perspective into the criminal justice system. As a result of a crime, victims often exhibit severe psychological consequences. In general, those victims that have suffered from sexual violence tend to show a higher level of adverse effects from the trauma of being in a violent and stressful encounter. Once in contact with the justice system, if the victim lacks the necessary safeguards, this can cause the victim to suffer greater complications than those caused by the crime itself. This means that without the proper assistance and support from all judicial officers in this matter, the victim carries a total refutation of its rights. The conception that is handled with respect to the victim in the Ecuadorian criminal system does not counter balance with the guarantees provided in the Constitution of the Republic of Ecuador. Therefore, this brings a clash between the expectations of the victim and the institutional reality. The most common form of secondary victimization is due to the numerous and repeated occasions that the victim has to testify. The objective of this research is to give an answer to determine the mode of reception of testimony that fits in their needs without violating rights of the accused, specific procedural reforms with new ways to ensure the privacy and safety of the victim. lt also involves the criminal justice system operators optimize the resources they possess in order to establish the ways in which the victim of sexual violence receive humane and dignified treatment that provides assistance, care and comprehensive security
