Resumen : | Desde la primera Constitución del Estado ecuatoriano, dictada en 1830 y de manera reiterativa en no menos de veinte posteriores, la nación ecuatoriana asumió al pacto o contrato social como fuente del nacimiento de la República del Ecuador y decidió que el poder público se exprese a través de las tres funciones tradicionales, a saber: Legislativa, Ejecutiva y Judicial, coincidiendo con la totalidad de Estados democráticos del mundo, así como con el pensamiento de los más importantes filósofos y juristas que se han ocupado de este tema. Sin embargo de lo anterior, desde enero de 2007 se han producido una serie de acontecimientos políticos, con sus respectivas consecuencias jurídicas que, sin considerar la tradición constitucional ecuatoriana, han desembocado en la vigencia de una nueva Constitución, que en lo fundamental declara al Ecuador como un Estado Constitucional de derechos y de justicia, en sustitución del Estado Social de Derecho, e instituye una división del poder público, inédita en el mundo, integrada por cinco Funciones: las tres tradicionales ya mencionadas en el párrafo anterior, una de Transparencia y de Control Social y otra Electoral… |
Descripción : | Starting with the Ecuadorian Constitution of the State, given in 1830 and in a reiterative way in no less than twenty subsequent, the Ecuadorian nation adopted the agreement or social contract as source of the birth of the Republic of Ecuador and decided that the public power be expressed through three traditional powers, such as: Legislative, Executive and Judicial, coinciding with all the democratic countries of the world, as well as with the thought of the most important philosophers and jurists that have worked with this subject. However the above mentioned, since January 2007 there have been a series of political events, with its respective legal consequences that, without considering the Ecuadorian constitutional tradition, have led to the validation of a new constitution, that in its essentials states Ecuador as a Constitutional State of rights and justice, in substitution of the Social State of Right, and it institutes a division of the public power, new in the world, integrated by five functions: the three traditional already mentioned in the previous paragraph, one of Transparency and of Social Control and one Electoral. |
