Descripción : Ecuador is strategically located in an area of high concentration of biodiversity, in such extent that is considerad the most biodiverse country in the world per square kilometer. lf we add to that the ancestral knowledge indigenous peoples posses on this biodiversity and the genetic resources, then we have a natural and cultural heritage that needs to be preservad and protected, but at the same time use in a sustainable way to address the basic needs of the Ecuadorian population as a whole. Unfortunately, the state has not generated public policies, national norms and strategies to usufruct in a proper manner this patrimony and rather bio-industry actors from developed countries have been the ones benefiting from it, in detriment of the country's sovereignty on this type of resources. The objective of this thesis for completion of a master's degree is above all to provide inputs that will be able to contribute with appropriated elements for accessing the traditional knowledge associated to genetic resources within the framework of respect for the collective rights of indigenous peoples. The proposed methodological elements on the free prior and informad consent for accessing such knowledge are the substantive part of this monograph providing an appropriated guide to indigenous cultural cedes, and according to the current national and intemational legal arder, as well as following legislativa developments that on this tapie have occurred in the countries of the region. Tapies on access to genetic resources and the associated traditional knowledge are a new category in the field of intellectual property, given that to this category are linked legal protection measures established for biotechnological innovations through invention patents. This thesis also analyses this situation and propases elements that contribute to control in a better manner national sovereignty on genetic resources, as well as the associated traditional knowledge that indigenous peoples possess. Finally, recommendations directed to the competent state agencies are placad, so that urgently legal protection measures for this knowledge are established and that together with biodiversity innovations become the new motor of the national economy.
