dc.descriptionIn the nineties, Ecuador experienced a significant foreign investment growth due to the rise of prices of minerals and metals. During this time, economic liberalization processes and removal of investment barriers took place. Mining concession systems were updated, thus increasing certainty to the mining rights and, consequently, to investors.The Mining Law 06 issued in the Government of Mr. Leon Febres Cordero, conceived the mining right as a real right, which empowered the mining contractor to carry out mining activities established by Law. The Mining Law, enacted in May 1991, described the mining concessions as a real and exclusive right, which empowered the mining concessionaire to run the exploration and exploitation activities as well as the implementation of other phases of the mining industry. The real right is the one that you have over a “thing”, namely, the real right engenders a relationship between a person and a tangible or intangible good.en
