Descripción : | Throughout the legislative history of Ecuador, there has been a permanent confusion of legal institutions in our penal codes such as mediate perpetration and intellectual perpetration, the current one without an exception. From these, Judicial Function has been forced to apply inaccurate legal concepts to every struggle submitted to them, and precisely for this reason it needs to emphasize that criminal proceeding aims to identify and individualize the perpetrator of a crime, and as consequence, determine the degree of participation, in order to impose a fair punishment. This investigation will focus on demonstrating the conceptual and practice difference between the different types of perpetration contemplated in Crime Law. By the above consideration we will analyze the conceptual and dogmatic structure that characterizes the mediate, intellectual and material perpetration. In order to achieve this, aim we will refer to the meaning of the “Teoría del Dominio del Hecho de Claus Roxin” as well as jurisprudence and emblematic cases in which it has been applied the mediate perpetration. We will also study the application of those responsibilities in the different types of offenses established in Ecuadorian criminal law. |
