dc.description | On February 4, 2018, a popular consultation was held where the Ecuadorian people spoke out in favor of providing greater protection to the Yasuní National Park, since it is recognized as a biosphere reserve worldwide. However, in 2019 executive decree 751 was issued which authorizes oil exploitation in the buffer area of the intangible zone located in the heart of Yasuní. Two peoples in voluntary isolation - Tagaeri and Taromenane - and part of the members of the Waorani indigenous nationality live in this area. Although there have been several legalinitiative attempts at popular consultations and a claim of unconstitutionality against Decree 751- no favorable result has been obtained that allows the effective protection of the biodiversity present in the park and of the human groups that live there. The need to declare the unconstitutionality of the decree will be justified because it is clearly contrary to what is established in three constitutional articles: art. 106 which establishes that popular consultations are mandatory, art. 71 of the CRE on the rights of nature and art. 57 on the rights of indigenous peoples and nationalities. | en |
