dc.description | This work deals with the responsibility of the State derived from the unjustified delay in the administration of justice. To address the main issue, the bases of responsibility and its evolution from the irresponsibility of the State to its objective responsibility are analyzed. Once the bases of the objective responsibility of the State have been established, they are applied to the liability regime that protects effective judicial protection through the analysis of the administration of justice. Consequently, the elements that must be analyzed in each case are established to understand whether the time taken by the State to obtain a resolution has been reasonable. Everything said above is analyzed in light of the case Salvador Chiriboga v. Ecuador, in which the Inter-American Court condemned the Ecuadorian State for unjustified delay in the administration of justice, forcing it to make full reparation. | en |
dc.description.abstract | Este trabajo versa sobre la responsabilidad del Estado derivada del retardo injustificado en la administración de justicia. Para abordar el tema principal se analizan las bases de la responsabilidad y su evolución desde la irresponsabilidad del Estado hasta la responsabilidad objetiva del mismo. Sentadas las bases de la responsabilidad objetiva del Estado, se aplican las mismas al régimen de responsabilidad que protege la tutela judicial efectiva a través, del análisis de la administración de justicia. Consecuentemente se establecen los elementos que se deben analizar en cada caso para comprender si el plazo que ha tomado el Estado para obtener una resolución ha sido razonable. Todo lo dicho anteriormente se analiza a la luz del caso Salvador Chiriboga vs. Ecuador, en el cual la Corte IDH condenó al Estado Ecuatoriano por retardo injustificado en la administración de justicia, obligándolo a la reparación integral. | es_ES |
