dc.description | The present essay seeks to analyze Chapter V of the General Code of Process, which contains in Art. 245 - 249 everything related to the process of abandonment of causes and the way in which judges interpret in a defective manner what is established in Art. 245, as well as the unstable assessment of the application of the term in the judicial proceedings. The objective of this document is: to reveal how the inadequate application of abandonment affected the procedural subjects at the time of the implementation of the General Organic Process Code in Ecuador. To achieve this, technical instruments were used, such as bibliographic review of books, legislative frameworks, resolutions that helped to create theoretical sustenance, and interviews were conducted with experts on the subject to broaden the perspective of knowledge. The main conclusion was that the inadequate application of the abandonment at the time of implementing the General Organic Code of Process violates a constitutional guarantee that must be repaired. | en |
dc.description.abstract | El presente ensayo busca analizar el Capítulo V del Código General de Proceso, el cual contiene en los Art. 245 - 249 todo lo relacionado al proceso de abandono de causas y la manera en que los jueces interpretan de manera defectuosa lo establecido en el Art. 245, así como la valoración inestable de la aplicación del plazo en los procesos judiciales. El objetivo de este documento es: develar cómo la inadecuada aplicación del abandono afectó a los sujetos procesales al momento de la implementación del Código Orgánico General de Procesos en el Ecuador. Para lograrlo se utilizó instrumentos técnicos como la revisión bibliográfica de libros, marcos legislativos, resoluciones que ayudaron a crear el sustento teórico, además se realizaron entrevistas a expertos en el tema para ampliar la perspectiva del conocimiento. La conclusión principal fue que la inadecuada aplicación del abandono al momento de implementar el Código Orgánico General de Procesos transgrede una garantía constitucional que debe ser reparada. | es_ES |
