Resumen : | En la presente tesis se analiza la tipificación penal de las conductas inobservantes de los delitos de propiedad intelectual, apoyando su estudio en el derecho comparado y en el desarrollo que la normativa ecuatoriana ha experimentado en la materia. El número creciente de delitos en esta materia, y su especialización, hace necesario contar con una legislación adecuada, coherente y efectiva para sancionar a esta clase de infracciones. Especial referencia merecen los avances tecnológicos que han transformado las formas de delinquir, resultando de ello víctimas desprotegidas ante la carencia de protección integral a los derechos intelectuales. En el estudio realizado se detectó que la propuesta que presenta el Proyecto de Código Orgánico Penal Integral resulta insuficiente para la realidad que el Ecuador vive actualmente, pues no hace sino reducir a un único artículo los delitos relacionados con la propiedad intelectual, limitándolos a la protección de obras literarias, artísticas, científicas y marcas registradas, por lo que se estaría dejando de lado temas tan trascendentales como el resguardo a las patentes, las indicaciones geográficas y los delitos informáticos. La investigación permite concluir la inconveniencia de agrupar en un mismo cuerpo legal, comportamientos típicos y antijurídicos que atentan contra bienes tan diversos como lo son la creación y el intelecto humanos, resultando mucho más acertado señalar conductas sancionables por cada rango de propiedad intelectual. |
Descripción : | The purpose of this work is to analyze the legal typification of the nonobservance regarding intellectual property felonies. This is a comparativa study upheld in Comparativa Law and in the development that Ecuadorian regulations on the matter have experienced. The increasing number offences in the matter have evidenced the necessity of the creation of appropriate legislation which can coherently and effectively punish them. Especial attention is given to the possibilities that technological progress has opened, leaving victims unprotected because of the lack of regulations in the lntellectual property field. The findings evidence that the proposal made in "Proyecto de Código Organice Integral Penal" is insufficient for the Ecuadorian reality nowadays. This last, supported in the fact that the project has reduced all clauses referring to intellectual property violation to a single clause which encloses protection to literary, artistic, registered trademark and scientific registered productions. Patent coverage, cybercrime, Geographic Denomination (PGD) and other relatad crimes. Results show that it is inconvenient to incorporate in the same legal body: both illegal and consuetudinary behaviors that go against human intelectual production. lt is more accurate to appoint punishable actions according to each rank of intellectual property |
