dc.descriptionThe phenomenon of drugs has constituted in a great problem worldwide from the point of political, economic, juristic, policing, social, and religious views. This is a complex topic that demands the generous attention of the jurists and especially the community. This problem requires an interdisciplinary investigation; to a radical reform of the national legislation, the modernization of the institution, and the people that arbitrate this problem. The global challenge of the countries in this sense should be to evaluative, discuss the lessons and failures left for the antidrug politics worldwide and the power to pose new paradigms of understanding and intervention. For this reason, the governments should start to consider the legalization as a possible method of reduction of this problem. In this aspect, the strategies for the legalization and legislation of the drugs will only have meaning if there is the will and compromise of the whole in the international community for taking action. However, this compromise should be promoted, protected, and supported by the major economic powers such as the United States and Western Europe for two reasons: 1) these countries remain the principal consumption centers of the world and the most profitable given their high purchasing power, and 2) Its long history of political influence in multifaceted agreements. The legalization points to eliminate the ability to criminalize and punish the consumption, production, and trafficking and sale of drugs by the state. In this situation, the submission that the states have pushed in the international legislation of drugs on the conviction that all of the countries have responsibility to address the problem and, therefore, their non-compliance would be a serious violation of their international compromises and responsibilities and a clear attack on the global governance of the issue. Ultimately, it is important to clarify that the changes in the antidrug politics and hence the international legislation should reflect functional relationships in different contexts and realities. The purpose of this paper is the research and analysis of the legalization of illegal drugs in the complicated national and international legislation that it supports and the barriers that they present for implementation. In this paper, a study will be made of the coverage and projections which has our Comprehensive Organic Penal Code within the sensitive topic of drugs. It is therefore intended by this research to propose an alternative from legal to combating the illegal drug business. That being the reason why I have chosen to develop this topic, and in turn to believe that hegemonic practices addiction is not as positive as could be achieved by implementing these policies or at least incorporating some of the practices that it poses are achieved.en
dc.description.abstractEl fenómeno de las drogas se ha constituido en un gran problema a nivel mundial desde el punto de vista político, económico, jurídico, policial, social y religioso. Se trata de un tema complejo que demanda la generosa atención de los juristas y sobretodo de la comunidad. Este problema obliga a una investigación interdisciplinaria, a una reforma radical de la legislación nacional, la modernización de las instituciones y de las personas que intervienen en esta problemática. El desafío global de los países en este sentido, debe ser el de discutir evaluativamente las lecciones y fracasos dejados por las políticas antidrogas a nivel mundial. Además, plantear nuevos paradigmas de entendimiento e intervención. Por esta razón, los gobiernos deberían empezar a considerar la despenalización, como método de reducción a este problema. En este aspecto, las estrategias para la despenalización y legalización de las drogas solo tendrán sentido si existiese la voluntad y compromiso conjunto de la comunidad internacional para adoptar una medida. Sin embargo, este compromiso debe ser impulsado, resguardado y respaldado por las grandes potencias económicas como los Estados Unidos y Europa occidental por dos razones: La primera es que estos países siguen siendo los principales centros de consumo del mundo y los más rentables dada su alta capacidad de poder adquisitivo; y segundo trata su amplia historia de influencia política en los acuerdos multilaterales...es_ES
