Resumen : En el presente trabajo de investigación se defenderá a la unión de hecho como una situación jurídica que no debería derivar en un nuevo estado civil. Esta puntualización es importante debido a que los efectos jurídicos que se desprenden de un estado civil son varios, pudiendo ahora, con la Ley Orgánica de Gestión de Datos Civiles, provocar indeterminación jurídica o ser susceptibles de interpretaciones ambiguas que produzcan un sin número de problemas al juzgador y por ende causar inseguridad jurídica a los convivientes. Este trabajo se encuentra dividido en tres secciones fundamentales. En la primera se expondrá y analizará la definición, origen, elementos, consecuencias y registro del estado civil. Esto nos permitirá tener una clara concepción de qué es y cuál es el fin de adquirir uno. La segunda parte se encuentra más enfocada a la concepción y desarrollo histórico de las uniones de hecho y se determinará sus características y naturaleza jurídica, por medio de la cuál podremos identificar con claridad de dónde nace esta figura y cómo situaciones y factores actuales han influido en el fortalecimiento o sentido que hoy en día tiene esta figura. Ésta segunda parte terminará con el análisis de la regulación que existe en el Ecuador respecto de los hogares de hecho originados por la convivencia estable y monogámica.
Descripción : In the present investigative work, domestic partnerships will be defended as a legal situation which should not give rise to a new marital status. This point is important due to the various legal effects that result from the creation of an official marital status, which now, with the Organic Law of the Management of Civil Data, could provoke legal uncertainties or be susceptible to ambiguous interpretations that could produce a number of problems for judges and result in legal insecurity for the cohabitating partners. This investigation will set forth various arguments that will support the idea that the legal nature of domestic partnerships is, in essence, a situation that should not generate any official marital status. The present work is divided into three fundamental sections. The first section will review and discuss the definition, origin, elements, consequences and registration of civil status. This will allow us to have a clear understanding of what is and what mean acquire one. The second part is more focused on the design and historical development of the domestic partnerships and their characteristics and legal nature is determined, through which we can clearly identify where this figure and how current situations and factors born have influenced strengthening or sense that today has this figure. This second part will end with the analysis of the regulation that exists in Ecuador regarding households actually caused by the stable and monogamous cohabitation.
