dc.descriptionFor several years the field of competition in Ecuador has been neglected and possible anticompetitive agreements that have arisen over the years have been unnoticed because of the lack of competition policy instituted in the country and at therefore, the lack of a competition authority, applicable law and especially the ignorance of the community. Ecuador is a concentrated and imperfect market because competitors have not been enough to encourage the development of our economy, and this has allowed certain companies to position themselves in the market by setting prices on products or services at your convenience, just only for economic benefit and to the detriment of consumers that we are all citizens and even the State as another consumer. Anticompetitive agreements are prohibited in the art. 11 of the Organic Law for the Regulation and Control of Market Power in force since October 2011. Such agreements are horizontal when they have been entered into between companies in the same link of the production chain, and vertical agreements are concluded between undertakings various links in the production chain. The latter are characterized by positive agreements with market effects, the purpose is not to restrict competition but to improve the whole business vertically to be more efficient, unlike the effects of horizontal agreements are per se harmful to competition and its object is about restricting supply in the market to set prices and at your convenience. In this paper titration performed an analysis of this type of non competitive agreements and each of the behaviors contained, in order to determine what should be the criteria under which we will proceed to investigate by the competition authority, and what arrangements should also be considered within the exception in art. 12 of the Organic Law for the Regulation, and each of the behaivors contained in the Law.en
dc.description.abstractPor varios años el ámbito de la competencia en el Ecuador ha sido descuidado y los posibles acuerdos anticompetitivos que se han suscitado a lo largo de estos años han sido desapercibidos, debido a la falta de una política de la competencia instituida en el país y por lo tanto, la carencia de una autoridad de competencia, una ley aplicable y principalmente el desconocimiento por parte de la colectividad. El mercado ecuatoriano es un mercado concentrado e imperfecto, debido a que no ha habido suficientes competidores que favorezcan al desarrollo de nuestra economía, y esta situación ha permitido que determinadas empresas se posicionen en el mercado fijando los precios de los bienes o servicios a su conveniencia para su único beneficio económico y en perjuicio de los consumidores que somos todos los ciudadanos e incluso al Estado por ser éste un consumidor más. Los acuerdos anticompetitivos están prohibidos en el art. 11 de la Ley Orgánica de Regulación y Control del Poder de Mercado vigente desde el mes de octubre del año 2011. Estos acuerdos son horizontales cuando han sido celebrados entre empresas de un mismo eslabón de la cadena productiva, y los acuerdos verticales son celebrados entre empresas de distintos eslabones de la cadena productiva. Los segundos se caracterizan por ser acuerdos con efectos positivos al mercado, cuyo objeto no es restringir la competencia sino mejorar toda la actividad comercial de manera vertical para ser más eficientes, a diferencia de los acuerdos horizontales cuyos efectos son per se nocivos a la competencia ya que su objeto versa sobre restringir la oferta en el mercado para así fijar los precios a su conveniencia.
