dc.descriptionThe extraordinary action of protection, fits against Court judgements or definitive acts in which it has been violated by recognized right action or omission in the Constitution, and it will interpose before the Constitutional Court. The action comes when the ordinary and extraordinary resources within the legal term have been exhausted, unless the lack of interposition of these resources were not attributable to the negligence of the titular person of the harmed constitutional right. The taken resolutions of last and definitive instance are connected to the concept of judged thing, that is to say, that the decisions are definitive and immutable, they contain a singular, concrete mandate and imperative, not to emanate of the will of the judge, but by mandate of the law, circumstances that until the constitutional model of 1998, did not allow to review the sentences. In essence these characteristics cause that the right does not become false, in order that no, reigns the uncertainty in the society. It is the uncertainty that causes injustice, the one that is due to come up and justifies the opening of the causes, single of extraordinary form as it demonstrates the own indicated constitutional action in article 94 of the Constitution. In the Constitutional State of Rights, the relation of extraordinary action of protection with the definability principles and immutabilityt of the judged thing, are obligatory. For that reason, the principles of thing judged developed mainly within the model of liberal state of right, without arriving to be restricted, nor that reduces its development and importance, extend indeed so that the extraordinary action is not considered like instrument of fourth instance. The revision of the judged thing of the acts and judgements, must have sense and look for criteria of coherence in the legal ordering as well as preserve the condition unquestionable of the fundamental rights and which had process that justifies the constitutional existence of this action, same that cannot arrive to be IX deformed or misappearance. The neoconstitutionalist current, upper implies the subordination of the law to the layer of the justice, that is the Constitution and to the organ guardian of its constitutional supremacy as it is it the Constitutional Court.en
dc.description.abstractLa acción extraordinaria de protección, cabe contra sentencias o autos definitivos en los que se haya violado por acción u omisión derechos reconocidos en la Constitución, y se interpondrá ante la Corte Constitucional. La acción procede cuando se hayan agotado los recursos ordinarios y extraordinarios dentro del término legal, a menos que la falta de interposición de estos recursos no fuera atribuible a la negligencia de la persona titular del derecho constitucional vulnerado. Las resoluciones de última y definitiva instancia ejecutoriados se conectan al concepto de cosa juzgada, es decir que las decisiones son definitivas e inmutables, contienen un mandato singular, concreto e imperativo, no por emanar de la voluntad del juez, sino por mandato de la ley, circunstancias que hasta el modelo constitucional de 1998, no permitían revisar las sentencias. En esencia estas características hacen que no se vuelva ilusorio el derecho, a fin de que no reine la incertidumbre en la sociedad. Es la incertidumbre que provoca injusticia, la que se debe prevenir y justifica la apertura de las causas, solo de forma extraordinaria como lo evidencia la propia acción constitucional señalada en el artículo 94 de la Constitución. En el Estado Constitucional de derechos, la relación de acción extraordinaria de protección con los principios de definibilidad e inmutabilidad de la cosa juzgada, es obligatoria. Por ello, los principios de cosa juzgada desarrollada principalmente dentro del modelo de estado liberal de derecho, sin llegar a ser restringidos, ni que se reste su desarrollo e importancia, trascienden efectivamente para que la acción extraordinaria no sea considerada como instrumento de cuarta instancia. La revisión de la cosa juzgada de los autos y sentencias, debe tener sentido y buscar criterios de coherencia en el ordenamiento jurídico así como preservar la condición indiscutible de los derechos fundamentales y debido proceso que justifica la existencia constitucional de esta acción, misma que no puede llegar a ser deformada o desconfigurada. La corriente neoconstitucionalista implica la subordinación de la ley al más alto estrato de la justicia, que es la Constitución y al órgano guardián de su supremacía constitucional como lo es la Corte Constitucional.es_ES
