Descripción : This study proposes a critical discussion on the creation of a Mental Health Law in Ecuador and its possible requirements. Such discussion is made from psychoanalytic theory and how it can be related to mental health proposal that is based on the standard and yet can be conjugated to the field of law, looking to find a common ground and divergences among these speeches. Additionally, one objective is to understand, beyond the mental health proposal, the implications of a law, not only at a macro or a social level, but at a particular level, where subjectivity is involved. The study takes as methodology content analysis that allows browsing through some texts about mental health, the field of law and some important authors in psychoanalytic theory, in order to explore the points of convergence and divergence as needed in order to sustain a position. The normativity in society and the particularity of the subject are permanent elements present in the everyday, constantly interacting. Talking in a psychoanalytically way of what can be regulated in the subject, makes to discuss about the Universal Law of Incest prohibition, not to mention that even though every person is confronted with the same fact, each one takes a unique position, leading to a subjective structure.
