| Descripción : | This research work seeks to show how in Ecuador not exist a legal mechanism that recognizes the right of filiation for same-sex couples. This, taking into consideration that the Constitution of the Republic recognizes the protection of the human rights of homoparental families, that is, of the descendants and identity of the children of male homosexual couples. This creates a legal vacuum. To this effect, the research is organized in three chapters. The first chapter presents a discussion on the scope and content of the right of samesex couples to form and maintain diverse families within the international context. This second chapter concentrates on the analysis of Ecuadorian legislation and the recognition of homoparental families in Ecuador, the conception of marriage and the union indeed of same-sex couples. This chapter concludes with a review of the elements debated in Constitutional Court judgement No. 184-18-SEP-CC of 29 May 2018 on the Satya case, and its arguments in relation to the right to the family of same-sex couples. Finally, the third chapter explores the mechanisms offered by the Ecuadorian State so that same-sex couples can access to the right to establish and maintain a family through descendants. |
