Resumen : En la presente tesis se analizará los diferentes tópicos respecto a la viabilidad de la acción de cancelación de los nombres comerciales por la falta del uso, basándonos en análisis doctrinarios respecto de las marcas y el nombre comercial con legislación conexa y la normativa ecuatoriana que refiere a la propiedad intelectual. Las falencias y desfases de criterios respecto al nombre comercial y a las marcas en el país y de la jurisprudencia emitida hasta el momento que han creado inseguridad jurídica, afectando el adecuado desarrollo de la gestión administrativa. Se establece un especial énfasis a la transformación del nombre comercial, su cancelación y la forma en las que se puede hacer extensiva y aplicable en el ámbito marcario. En el estudio realizado se detectó que la acción de cancelación de los nombres comerciales no sólo tiene incidencia en el ámbito académico, sino que busca convertirse en una guía y en un parámetro para la aplicación misma de las normas por parte de la administración en el país. Establecemos entonces que el registro de un nombre comercial aplicado de acuerdo a la doctrina y de la naturaleza de la posibilidad de que quede sin efecto el registro concedido por el Instituto Ecuatoriano de Propiedad Intelectual, desencadenando en la cancelación por la falta del uso, en la que, de acuerdo a la doctrina, es necesario el uso para evitar acaparamiento, con salvedad de que dicho nombre comercial se vulgarice y sea notoria. Respecto de la normativa andina, ésta es de cumplimiento obligatorio tanto en la instancia administrativa como en la judicial. En caso de dudas respecto de la aplicación de una norma específica, el organismo competente es el Tribunal Andino de Justicia quien se pronuncia a través de interpretaciones prejudiciales. Ya en el trabajo diario de la administración pública surge la necesidad de los jueces administrativos de aplicar la normativa comunitaria y nacional de Propiedad Intelectual al dictar sus resoluciones, es en ese momento cuando se pone de manifiesto la importancia del presente estudio, ya que dichos actos administrativos, a la luz de las normas y la doctrina, muchas veces generan duda respecto de la correcta aplicación de las disposiciones legales, siendo indispensable un análisis profundo que dilucide estas cuestiones y aporte a la seguridad jurídica y a la ciencia.
Descripción : This thesis will discuss different topics regarding the viability of the Cancel action of trade names by the lack of use, based on doctrinal analysis with respect to trademarks and trade name with related legislation and Ecuadorian legislation referring to intellectual property. The shortcomings and gaps of criteria with respect to the trade name and brands in the our country and the jurisprudence issued so far have created legal uncertainty, affecting the proper development of administrative management. Establishes a special emphasis to the transformation of the trade name, its cancellation and the way in which can be extensive and applicable in the trademark field. The action for cancellation of trade names not only has impact on the academic field that seeks to become a guide and a parameter for the same application of the rules by the Administration in the country was detected in the study. We establish that the registration of a trade mark applied according to the doctrine and the nature of the possibility that is without effect the registration granted by the Ecuadorian Institute of intellectual property, triggering the cancellation due to the lack of use, that is according to the doctrine it is necessary to use to avoid hoarding, with caveat that the brand name is vulgarice and is notorious. With regard to the Andean regulations, this is mandatory both in the judicial and the administrative instance. In the event of doubts as to the application of a specific rule, the competent body is the Andean Court of Justice who pronounce through preliminary interpretations. Resumen : El presente trabajo de titulación propone una nueva forma de entender la cultura y desafía a la industria al promover el derecho legal y social a usar los bienes intelectuales. El copyleft se ha convertido en un movimiento que ha comenzado a cobrar fuerza en los últimos años, agrupa decenas de pequeñas y grandes iniciativas que plantean una vía alternativa tanto a los derechos de autor como al modelo de producción cultural de nuestra época. Inicialmente, se originó con el objetivo de Compartir el legítimo derecho a usar libremente obras culturales autorizadas y distribuirlas de la misma manera. Sus precursores aseguran que el objetivo fundamental que persigue el copyleft es que los autores que estén de acuerdo con esta corriente puedan vivir de su trabajo sin restringir el derecho de los lectores a la copia. Además analizan que a raíz de la implementación de las TIC se ha provocado en numerosos casos marginación debido a los altos costos para el acceso a un bien intelectual, convirtiéndolo en una mercancía; por lo tanto, promueven la implementación de las licencias de conocimiento libre como Copyleft, Creative Commons, Arte Libre, Licencia Pública General GPL, MPL, entre otras para asegurar y proteger la libertad del conocimiento generado por el hombre para beneficio de la sociedad. Por nuestra parte, y apoyados en un análisis y comparación, planteamos que la acción del Copyleft tiene un campo de aplicabilidad y funcionalidad mucho más amplio, siendo una nueva opción que favorece el desarrollo de todos los derechos intelectuales, ya que solo así puede darse pie a una definición de normas abiertas, estables y neutrales dentro del marco legal vigente. Por lo tanto, desde el punto de vista legal el titular del derecho intelectual es el dueño soberano de su bien y tiene, según la ley, pleno derecho para decidir sobre esta; para lo cual se propone una normativa legal que regule la aplicabilidad y funcionalidad del copyleft como una nueva identidad y opción para la protección de los derechos y bienes intelectuales.
Descripción : This paper proposes a new titling way to understand culture and challenges the industry to promote legal and social rights to use the intellectual property. Copyleft has become a movement that has started to gain momentum in recent years; it brings together dozens of small and large initiatives that pose an alternative to both copyright and the cultural production model of our time. Initially, it started with a goal of sharing the legitimate right to freely use authorized cultural works and distribute them in the same manner. Precursors ensure that the fundamental objective of the copyleft is that authors who agree with this current can live from their work without restricting the right of readers to copy. Furthermore they analyze that following the implementation of ICT has led, in many cases, to marginalization due to the high costs of access to an intellectual good, making it a commodity; therefore, they promote the implementation of free knowledge licenses as copyleft, Creative Commons, Free Art, General Public License GPL, MPL, including measures to secure and protect the freedom of knowledge created by man for the benefit of society. Supported by an analysis and comparison, we propose that the action of Copyleft has a range of applicability and functionality much broader, with a new option that favors the development of all intellectual property rights, and only then it can give a broad definition of open, stable and neutral standards within the existing legal framework. Descripción : The role of Intellectual Property lawyers not only to apply the normative efficiently, it is necessary to identify problems and propose practical solutions. So, although the figure of the trademarks nullity is regulated by the Andean Community rules, the fact remains that there are some problems of practical implementation by national authorities and users of the system, exist normative darkness. As such, considering the imminent reform of the Intellectual Property Law, it is appropriate to remedy existing problems through the reform of national legislation to regulate and clarify three fundamental aspects: Competition; filing terms and differentiation with the Revision Recourse and other actions. Título : Guía para publicistas sobre el manejo legal de la Propiedad Intelectual en la Publicidad Ecuatoriana

Resumen : Este trabajo surgió de la necesidad de los publicistas ecuatorianos de conocer más sobre la protección legal que pueden o no tener sus creaciones y bajo qué condiciones, ello inspiró la investigación y el desarrollo de una guía que les explique sus derechos intelectuales, la protección de sus obras y las pautas a seguir para incorporar legalmente obras ajenas en sus piezas publicitarias. A pesar de que la ley no menciona a las creaciones publicitarias como obras protegidas, mediante la investigación bibliográfica se concluyó que sí lo son y se determinó el tipo de protección legal que pueden tener a través de las diferentes áreas de propiedad intelectual, además de definir la relación entre publicidad y competencia desleal y sus implicaciones legales. La tesis tiene un estudio descriptivo con un enfoque cualitativo; se tomó una muestra de expertos de 4 grupos involucrados; se aplicó entrevistas para identificar las infracciones más comunes en propiedad intelectual y competencia desleal cometidas por los publicistas, sus principales causas y formas de evitarlas; también se definieron los temas que los publicistas necesitan conocer para proteger sus obras creativas y evitar infracciones. El estudio indicó que las principales infracciones son: uso de obras protegidas sin autorización, apropiación de elementos existentes mediante plagio servil o elaborado, uso de marcas sin autorización; en competencia desleal, actos de: confusión, engaño, imitación, denigración, comparación sin pruebas, explotación de la reputación ajena. Entre las causas de estas infracciones están: desconocimiento y facilismo; las formas de evitarlas son: mayor conocimiento del tema y asesoramiento con abogados especialistas en propiedad intelectual. En función del grupo objetivo, la propuesta tiene un esquema simple de pregunta y respuesta, un formato común en el medio publicitario; para quienes desconocen el vocabulario legal el lenguaje es sencillo y amigable sin perder la esencia jurídica; los temas desarrollados en la propuesta se basan en los resultados de la investigación. Todos los entrevistados afirmaron que la guía será útil debido a la escasez de fuentes sobre el tema, lo que permite concluir que la divulgación de la investigación y de los lineamientos que de ella surgieron, sería una interesante contribución para el medio publicitario.
Descripción : This research project grew out of the need for Ecuadorian advertising professionals to learn when and how to protect their intellectual property. This question inspired this research on this topic, as well as the development of a guide detailing the intellectual property rights of such professionals. The research project and guide examine how advertising professionals can protect their work. This project also develops a series of guidelines that should be followed in order to respectfully incorporate creative works by other professionals in their own advertising materials. Even though the legal framework in Ecuador does not explicitly mention advertising material as intellectual property, this research shows that this material is in fact protected under Ecuadorian law. The research details wha type of protection advertisements warrant, and which spheres of intellectual property law apply. Further, it explains the link that exists between advertising and unfair competition, and elucidates the legal implications of the latter. This dissertation contains a descriptive study with a qualitative focus. A sample of experts was selected from 4 groups of stakeholders. They were interviewed in order to identify the most common violations of intellectual property law and the most prevalent unfair competition tactics employed by advertising professionals, as well as pinpointing the main causes of these issues, and how to avoid them. The research also provides advertising professionals with the information they need in order to protect their creative work and avoid infringing on other professionals’ work. The study highlights a few recurring breaches. With respect to intellectual property, it covers the use of protected material without authorization, the appropriation of existing elements whether through servile imitation or more elaborate forms of plagiarism, and the unauthorized use of branding. With regards to unfair competition, the thesis examines acts of confusion, deception, imitation, defamation, unfounded comparisons and misappropriation. Because some of these infractions are committed due to misinformation or expediency, the best way to avoid them is to become better informed on the subject and seek advice from attorneys specializing in intellectual property law. For ease of use of the target group, the guide is presented in a simple question and answer format, which is fairly common in the advertising world. The decision was made to steer away from complex legal jargon, in order to aid comprehension in readers unfamiliar with legal terminology, without disregarding the legal issues involved. The issues discussed in this proposal are based on the results of the research carried out. All of the interviewees have given their assurances of the usefulness of this guide. In fact, there is a dearth of such resources available to them. As such, this research, and the guide that has resulted from it, will make an indelible contribution to intellectual property scholarship, as well as to the Advertising field.2015-01-01T00:00:00Z
