dc.descriptionThe commercial trust figure is a tool used for developing practically any type of business, among which are included real estate projects. On the other hand, the regular real estate trust figure is a very successful and widely used tool that develops real estate projects, especially by constructionfirms with great economic strength. In third place, the real estate trusteeship at final cost is a figure that is used broadly in countries such as Argentina and Uruguay. In Ecuador, there are people that try to use it more and more, however, and due to the lack of regulation and absence of a specific regulative normative, the situation generates impossibility in terms of applying such figure without infringing its own nature. The objective of this essay is to analyze the characteristics of the real estate trusteeship at final cost figure, in order to demonstrate the differences that presents it to the regular real estate trust, and thereby, the necessity to regulate such figure. Finally, this work analyses how the real estate trusteeship at final cost figure in Ecuador, under the current normative, results impossible to be applied without vitiating the contractual nature of such figure.en
dc.description.abstractLa figura del fideicomiso mercantil es una herramienta utilizada para realizar prácticamente todo tipo de negocios, entre los cuales se incluyen los proyectos inmobiliarios. Por otro lado, la figura del fideicomiso inmobiliario ordinario es una herramienta exitosa y muy utilizada para desarrollar proyectos inmobiliarios, sobre todo, por constructoras con un gran poderío económico. En tercer lugar, el fideicomiso inmobiliario al costo es una figura con un amplio uso en países como Argentina y Uruguay. En Ecuador hay quienes la intentar utilizar, pero debido a la falta de regulación y sobre todo a la ausencia de una normativa expresa que la regule, esta situación genera imposibilidad de aplicar dicha figura sin vulnerar la naturaleza de la misma. El presente ensayo tiene como objetivo analizar las características del fideicomiso inmobiliario al costo, para así demostrar las diferencias que presenta frente al fideicomiso inmobiliario ordinario, y por ende visibilizar la necesidad de regulación de dicha figura. Finalmente, se analiza cómo la figura del fideicomiso inmobiliario al costo en el Ecuador, bajo la normativa vigente, resulta imposible de aplicar sin viciar la naturaleza contractual de dicha figura.es_ES
