dc.descriptionThe following degree project deals with the legal effects generated when a pathological clause is identified in an arbitration agreement. The pathological clauses are those that, despite being present in an arbitration agreement, preclude the direct resolution of a controversy by an arbitrator or arbitral tribunal, however they do not grant this competence directly to ordinary judges. Pathological clauses generate the need for arbitrators to carry out an analysis of the agreement, using tools for interpretation such as jurisprudence and the Civil Code, so that protected by the principle of arbitration and the power granted by the Kompetenz-Kompetenz principle, they can decide about their own competence and start the arbitration process, which will conclude in an award. An arbitration agreement is made up contents which are necessary and others which are optional, since the necessary contents are the mandatory provisions that must be stated in the text so that it can supply effects, the optional contents are those guidelines that the parties can include to personalize their arbitration process. It is in this last mentioned content where the parties may incur some pathology due to the addition of excessive details or very specific determinations. The legal nature of an arbitration agreement is not yet well defined, it is for this reason that we can identify a contractualist theory, a jurisdictional one and finally an eclectic one that goes back to complement the first two. As a result of considering the last theory the most complete, and the inclusion in it of the theory of contractualism, the present work, defines validity, nullity and effectiveness as legal effects of the acts and declarations of will, which include the arbitration agreements, and determines which will be applicable to each type of pathology.en
