Descripción : In this paper we analyze the concept of "mandatory waiver" contained in Article 8 of Executive Decree 813, published in Official Gazette Supplement No. 489, dated July 12, 2011, and its effects on staff untying several belonging to state institutions: Ministry of Public Health, Ministry of Interior, Ministry of Urban Development and Housing, other. What provoked an immediate reaction from the unions, Provincial Federation of Public Servants of Pichincha (FENASEP) and the National Confederation of Public Servants (CONASEP) who presented to the Constitutional Court the constitutional claim. The many sources of information that exist on this subject, being of national and international knowledge, allowed to meet the Kyoto targets, eg, letter k) of Article 47 of the LOSEP, establishes the existence of waivers purchases with compensation, but not "mandatory". While many jurists, like Julius Caesar Trujillo, assert that the waiver is legally recognized provided that such waiver is freely consented by resigning, but when it is required, it is a wrongful dismissal. The research also includes a summary of the process used by the victims of Decree 813 with the Constitutional Court claiming it unconstitutional, as well as the drafting of the judgment on the demand made by Judge Roberto Bhrunis, through which, the full Court is declared competent to review the issue, considering that it is the duty of the Administrative Court. The study leads to the conclusion that "compulsory purchases waivers" do not exist in Ecuadorian law, reason, Art 8 of Executive Decree 813, published in Official Gazette Supplement No. 489 of July 12, 2011, is an act unconstitutional because it violates article 66 paragraph 29, letter d) of the Constitution, which provides that no person may be compelled to do something forbidden or stop doing something not prohibited by law, a fact that generates an image refusal of our country with the national and international community.
