| Descripción : | The private copying has been recognized in several countries as a limit to the exercise of copyright and related rights. The system of private copying is covered by the provisions of the Berne Convention for the Protection of Literary and Artistic Works; in that agreement, the possible exceptions to the reproduction rights are established. These exceptions are known as the Three Step Rule. As a consequence of the limit of private copying, right holders have the legitimate right to receive compensatory remuneration for the damage they suffer since their work is being the subject of a private copy. In Ecuador, the private copy was recognized since 1998 with the promulgation of the Intellectual Property Law; however, the Organic Code of the Social Economy of Knowledge (COESC), published in the Official Register on December 9th, 2016, eliminated the figure of the private copy and consequently the compensatory remuneration that the right holders received reproduction. |
