dc.descriptionAs a guarantee of the constitutional rights that the States of Law must provide to their citizens, there is respect for the separation of powers. The structure that conforms this principle is the independence and the respect to each state function. Nevertheless, throughout history has been maintaining a constant struggle for such respect to be fully respected, in such a way that none of these powers bursts the other affecting the independence that characterizes them, and for this reason the rights of citizens are affected. As Montesquieu states in his theory of division of powers, the State must have three functions, one executive, one legislative and a judicial, to which certain functions will be assigned according to the area that they must control and guarantee. Of the Judicial Power, which is the object of this work, it shows that it is a power that is invisible and separated from the other powers, since it is in charge of the administration of justice of conflicts that are generated in its territory and that no power outside the Judicial Function should intervene in the decisions that the judges take. Is for this reason that a Judiciary Council is established legally with the purpose that a single organ, outside the other functions of the State, is responsible for the government and administration of the Judicial Function, which within its functions is responsible of the selection, assent, stability, removal and discipline of judges and judicial servers, in the margin of the administrative scope. That is to say, the Judiciary Council should exercise its disciplinary authority, regulation and control over the behavior that judges keep on the Judicial Function, and not on the decisions made by them, otherwise, the principle of judicial independence would be affected.en
dc.description.abstractComo garantía de los derechos constitucionales que los Estados de Derecho deben brindar a su pueblo, se encuentra el respeto al principio de separación de poderes. La estructura que conforma este principio es la independencia y el respeto a cada función estatal. Sin embargo, a lo largo de la historia se ha venido manteniendo una constante lucha para que dicho respeto sea acatado a cabalidad, de tal manera que ninguno de estos poderes irrumpa al otro afectando la independencia que les caracteriza, y que por esta razón los derechos de los ciudadanos se vean afectados. Como lo manifiesta Montesquieu en su teoría de división de poderes, el Estado debe tener tres funciones, una ejecutiva, una legislativa y una judicial, a los que se le asignarán determinadas funciones de acuerdo al área que deben controlar y garantizar. Del Poder Judicial, que es objeto de este trabajo, manifiesta que es un poder que se encuentra invisible y separado de los demás poderes, ya que a su cargo se encuentra la administración de justicia de conflictos que se generen en su territorio y que ningún poder ajeno al de la Función Judicial, debería intervenir en las decisiones que los jueces tomen. Es por tal razón, que se instaura legalmente un Consejo de la Judicatura con la finalidad de que un solo órgano, ajeno a las demás Funciones del Estado, se encargue del gobierno y administración de la Función Judicial, y que dentro de sus atribuciones tenga a su cargo la selección, ascenso, estabilidad, remoción y régimen disciplinario de los operadores de justicia, tales como jueces, fiscales y defensores públicos. Es decir, el Consejo de la Judicatura debe ejercer su potestad disciplinaria, de regulación y control sobre la conducta que los jueces mantengan dentro de la Función Judicial, y no sobre las decisiones y fallos que ellos realicen, ya que en caso de hacerlo, el principio de independencia judicial se vería afectado.es_ES
