Resumen : La legalización del Cannabis Sativa para el tratamiento de enfermedades, está dando un giro en la visión jurídica, política, económica y social de los países. Esta propuesta está transformando la forma de ver una planta que por muchos años sufrió el trato político diferenciado y que por ende se convirtió en una sustancia ilegal, de este modo se escondió y se evitó de alguna manera que los beneficios que traen consigo sus componentes pudieran tener no solo un uso recreativo sino también, que puedan ser utilizados en el campo medicinal. Este trabajo trata de dilucidar el por qué cambió el estatus legal en la utilización de esta planta y cómo a lo largo de este tiempo las legislaciones de muchos países han optado por reformar sus normas y permitir su uso no solo recreativo sino también abrir el campo de la investigación científica y analizar sus beneficios médicos para tratar diferentes tipos de enfermedades. Se realiza un estudio objetivo y concreto dentro del campo jurídico, pasando por su estatus legal, sus antecedentes jurídicos en el cual se analiza la evolución legal del Cannabis Sativa, su empleo y usos, como también el estudio de su regularización jurídica, los beneficios en el campo médico y que enfermedades en la actualidad están siendo tratadas con los componentes del Cannabis Sativa. El problema jurídico nace de la incoherencia entre la Constitución de la República del Ecuador y el Código Orgánico Integral Penal, donde por un lado la norma suprema señala que el Estado está obligado a garantizar a todas las personas que sufran de enfermedades catastróficas el derecho a la atención especializada y gratuita en todos los niveles, de manera oportuna y preferente y el Código Orgánico Integral Penal, impide que se pueda optar por el análisis o estudio científico médico del Cannabis Sativa ya que al estar prohibido su cultivo, producción y tráfico no permite que mediante estos estudios se analice los beneficios médicos que pueden brindar sus componentes. El tema principal trata que el Cannabis Sativa adquiera el estatus legal para que de esta forma los gobiernos ecuatorianos a través de las instituciones creadas para el efecto sean ellas quienes controlen, produzcan, fabriquen y encuentren métodos alternativos de aliviar las enfermedades de índole catastrófica a través de la utilización del Cannabis Sativa. También dentro de lo que se refiere a los derechos humanos se hace un análisis en el cual se enfatiza la vida y la libertad, derechos humanos muy preciados que mediante estos postulados una persona con una enfermedad terminal puede decidir qué tipo de tratamiento le es más favorable para aliviar las molestias y hasta curar sus dolencias.
Descripción : The legalization of Cannabis Sativa for the treatment of diseases is turning in legal economic and social vision, policy, countries. This proposal is transforming the way we see a plant that for many years suffered the differentiated political deal and that therefore became an illegal substance, thus hid and avoided somehow the benefits they bring their components could have not only but also recreational use, which can be used in the medical field. This paper tries to clarify why it changed the legal status in the use of this plant and how throughout this time the laws of many countries have chosen to reform their rules and allow its use not only recreational but also open the field scientific research and analyze their doctors to treat different types of diseases benefits, an objective and concrete study within the legal field, through its legal status, its legal background in which the legal evolution of Cannabis Sativa, use and uses, as well as studying its legal regularization, benefits analyzes performed the medical field and diseases currently being treated with the components of Cannabis Sativa. The legal problem stems from the inconsistency between the Constitution of the Republic of Ecuador and the Comprehensive Organic Code of Criminal Procedure, where on one hand the supreme rule states that the State is obliged to ensure to all persons who suffer from catastrophic illnesses the right to specialized and free at all levels of care, timely and preferred manner and COIP makes it impossible to opt for the analysis or doctor Sativa Cannabis scientific study since being banned its cultivation, production and trafficking does not allow that through these studies analyze the medical benefits that can provide its components. The main theme is the Cannabis Sativa acquires legal status so that in this way the Ecuadorian government through the institutions created for that purpose is they who control, produce, manufacture and find alternative methods of alleviating the diseases catastrophic nature through the use of Cannabis Sativa.
