dc.descriptionThe main objective of the following paper is to emphasize the effect that a restraining order has. Once a restraining order has been stablished favoring one party and opposing another; those who have children in common will implicitly affect the right of children to maintain a frequent affective and direct relationship with both parents. Such right that has been established in the “Código Orgánico de la Niñez y la Adolescencia” in the article 21. It has been demonstrated by the following investigation that restraining orders and other ways of protection have been misused. This protection tool has been used as a way to prevent the emotional bond between a child and the parent who has the restraining order And therefore it is missing the important principle of the law of childhood and adolescence, which is the principle of the best interests of the child, which assumes that the authorities at the time of issuing decisions in court cases in which they are opposing one a or more rights; One should prioritize the rights of children and adolescents, guaranteeing and making effective most of the rights of this group of priority attention On the other hand, the obligation of the parents are limited, to mutually take care of their children, raise them and educate them; the responsibility to promote a comprehensive development and protection of the rights of children in common. Principle established in article 100 of the same law. To address this gap, one proposes the implementation of supervised visitation, which are temporary measures in favor of children who have limited contact with a parent, because of these measures of protection, including the restraining order; while they have not been the victims of violence. Finally, one proposes the creation of family meeting points, which will be the places where such supervised visits take place, in a safe environment for children and adolescents.en
dc.description.abstractEl presente trabajo de titulación tiene como objetivo principal, determinar que, al momento de emitirse una boleta de auxilio a favor de una persona en contra de otra, quienes tienen hijos en común; implícitamente se afecta al derecho de los hijos a mantener un vínculo afectivo frecuente y directo con los dos progenitores, derecho que se encuentra consagrado en el Código Orgánico de la Niñez y la Adolescencia en su artículo 21. Se ha demostrado en la presente investigación que también ha habido un mal uso de las boletas de auxilio y demás medidas de protección; tratando por medio de éste instrumento, entorpecer el vínculo afectivo entre un niño y su progenitor, en contra quien se emite la boleta de auxilio. Y, por ende, se está faltando al principio rector de la legislación de la niñez y la adolescencia, que es el principio del interés superior del niño, el cual supone que las autoridades al momento de emitir sus decisiones en casos en lo que se encuentren contrapuestos uno a o más derechos; se debe priorizar los derechos de los niños, niñas y adolescentes, garantizando y haciendo efectivos la mayor cantidad de derechos de este grupo de atención prioritaria. Por otro lado, se está limitando la obligación de los progenitores a mutuamente cuidar de sus hijos, criarlos, educarlos; la responsabilidad de propiciar un desarrollo integral y la protección de los derechos de los hijos en común. Principio establecido en el artículo 100 del mismo cuerpo legal. A fin de subsanar este vacío legal, se propone la implementación de visitas supervisadas, que son medidas temporales, a favor de los niños que se encuentran impedidos de contacto con un progenitor, a causa de estas medidas de protección, entre ellas la boleta de auxilio; a pesar de que ellos no han sido las víctimas de violencia. Finalmente se propone la creación de puntos de encuentro familiar, que serán los lugares donde se desarrollarán dichas visitas supervisadas, en un ambiente seguro para los niños, niñas y adolescentes.es_ES
