| Descripción : | This paper gathers the criteria from the Latina American Tax Law Institute, the Organization for Economic Cooperation and Development, and the United Nations regarding intangible assets, and makes known the lack of treatment given to intangible assets in relation to taxation. By comparing legislations and international treaties it is conclusive that none of these defines in a general way what an intangible asset is, and therefore making it impossible to establish income generated by them, and taxing it. The International Accounting Standards (IAS) widely developed on the definition, identification and valuation of intangible assets. Incorporating the definition of intangible assets contained in IAS to tax laws would benefit entities that own and develop intangible assets as well as Tax Administrations in tax collections labor. |
