| dc.description | This thesis is an analysis of issues regarding the protection of traditional knowledge and their regulation, is a proposal to regulate the use of traditional knowledge taking into account the viewpoints of both important sides, the Indigenous communities and combine them with the legal system force. This thesis has made a study of what exists on the subject, in a national and international way; is studying proposals for protection in different international organisms, for example, the Andean Community of Nations (CAN), the Convention on Biological Diversity (CBD), the World Property Organization (WIPO), among others. As a result, from the study of these international organisms, the conclusion is that their proposals, however they are good, are in the air, without any useful outcome for our nations despite being excellent and very practical proposals for implement and to end the lack of protection of traditional knowledge. In the case of Ecuador, we find that there is really very little to talk and almost doesn’t exist anything about the protection of them, because we don’t have a system that focuses on protecting traditional knowledge and there are no plans, projects or visions about this theme, that is really an oversight that has been a pressing need within our country but very few are interested. For these reasons, this thesis seeks to propose an alternative to regulate the protection of traditional knowledge, and draws on the proposal to begin by building an internal and national standard for this need and after discuss, implement, and practice internally in our country, we can extend to a regional and international vision to curb the abuses that have been committed within the topic. In conclusion, the contribution of this thesis to the problem is the creation of a legal concept that protects traditional knowledge, taking into account the cultures and customs of the Indigenous communities and linking this factor with the existing legal parameters in Intellectual Property Law force, creating a protection to traditional knowledge as communities that contain them. | en |
| dc.description.abstract | Ésta tesis es un análisis sobre la problemática en cuanto a la protección de Conocimientos Tradicionales se refiere y que tanta falta hace regularlos, es decir, es una propuesta de normar el uso de los Conocimientos Tradicionales tomando en cuenta los puntos de vista tanto de comunidades indígenas como del sistema legal interno y los sistemas internacionales existentes. Se ha hecho un estudio sobre las normas, tanto nacional como internacionalmente, en esta última se estudian propuestas de protección como la de la Comunidad Andina de Naciones (CAN), la Convención de Biodiversidad Biológica (CDB), la Organización Mundial de Propiedad Intelectual (OMPI), entre otros.
