dc.descriptionThe present topic of investigation proposes the need to establish the applicability or irrelevancy of the article 374 of the Intellectual Property Law in reference to the submission to arbitration of the Ecuadorian Institute of Intellectual Property. The above named article states that any dispute relating to intellectual property may be submitted to arbitration or mediation. Under this scheme, the question arisen is whether the Ecuadorian Institute of Intellectual Property (IEPI) may submit to arbitration disputes relating to intellectual property anyone may have with individuals putting aside its sovereignty, power of imperium in its power to exclusive defense and protection of intellectual property rights in which is immersed the public interest and for which the IEPI is called to perform their duties and fulfill its purpose fully.en
