Descripción : This research aims to determine if the electoral system applied for the elections of the Ecuadorian National Assembly Members is compatible with the constitutional mandate of proportionality stablished in the article number 116 of the Constitution. In order to achieve this it will determine the concept of electoral system and acknowledge the principles of representation as well. To evidentiate the disproportionate effects, this research will provide an analysis regarding the election held in 2013, which will determine that, by being the majority of circumscriptions small, plus the fact that there are an average of 10 political organizations that participate on each electoral district for the assignation of 4 assembly posts, a structural disproportionality of the electoral system is generated. It is also important to considerate that the method applied in Ecuador for the assignation of assembly posts in province, sub province, districts and overseas (D´Hondt) circumscriptions tends to be by majority, the existing disproportionality increases even more. That is why, in order to comply with the constitutional mandate, this research proposes a compensatory voting system which will contribute to the application of the proportionality principle established in the article 116 of the Ecuadorian Constitution.
