Resumen : La figura del Oficial de Cumplimiento surge como una necesidad, para la prevención de lavado de activos y financiación de terrorismo en entidades del sistema financiero, como es el caso de los bancos privados. Así también en las compañías aseguradoras, y en las casas valores, siendo éstas entidades expuestas al riesgo del lavado de activos y financiación de terrorismo. Podemos destacar la gran responsabilidad que tienen las entidades bancarias con los ahorros de sus clientes, tieniendo la importante y delicada tarea de garantizar los ahorros de la comunidad.El orígen de los fondos o capital con el que se puede aperturar una cuenta en un banco privado, puede provenir de diferentes actividades económicas entre ellas las delictivas, utilizando al banco privado como un instrumento para lavar el dinero, es decir darle una apariencia de legalidad.El presente trabajo investigativo está comprendido por cuatro capítulos. En el primer capítulo podremos encontrar una descripción del sistema financiero ecuatoriano y una descripción de giro de negocio de bancos privados, compañías aseguradoras y las casas de valores. Y finalmente en este primer capítulo encontramos el riesgo que tienen estas entidades controladas al lavado de activos y financiación de terrorismo. En el segundo capítulo encontramos la historia del oficial de cumplimiento, la normativa estadounidense, chilena, panameña y colombiana. Así como encontramos la normativa ecuatoriana vigente sobre el Oficial de Cumplimiento, en la que encontramos sus principales funciones, jerarquía, caracterización. El capítulo tercero trata sobre los controles a cargo del Oficial de Cumplimiento dentro de las entidades controladas, es decir la labor concreta que debe desarrollar el Oficial de Cumplimiento dentro de las entidades controladas para la prevención de lavado de activos y financiación de terrorismo.Y finalmente en el capítulo cuarto se encuentran las conclusiones y recomendaciones de este trabajo investigativo.
Descripción : The figure of the Compliance Officer arises as a need, for the prevention of wash of assets and financing terrorism in entities of the financial system, since it is the case of the private banks. This way also in the insurance companies, and in the houses value, being these entities exposed to the risk of the wash of assets and financing terrorism. We can emphasize the great responsibility that the bank companies have with the savings of his clients, they have the important and delicate work of guaranteeing the savings of the community. The origin of the funds or cardinal with that an account can aperturar in a private bank, can come from different economic activities between them the criminal ones, using to the bank deprived as an instrument to wash the money, that is to say to give him an appearance of legality. The present work of investigation is understood by four chapters. In the first chapter we will be able to find a description of the financial Ecuadorian system and a description of draft of business of private banks, insurance companies and the houses of values. And finally in this first chapter we find the risk that there have these entities controlled to the wash of assets and financing terrorism. In the second chapter we find the history of the official of fulfillment, the American, Chilean, Panamanian and Colombian regulation. As well as we find the Ecuadorian in force regulation on the Compliance Officer, in which we find his principal functions, hierarchy, characterization. The third chapter treats on the controls at the expense of the Compliance Officer inside the entities controlled, that is to say the concrete labor that the Compliance Officer must develop inside the entities controlled for the prevention of wash of assets and financing terrorism. And finally in the fourth chapter they find the conclusions and recommendations of this investigative work
