dc.descriptionThe following is a study of the penal code in Ecuador as it relates to human trafficking, with an objective of analyzing the existing problems present within that area of law. This is an issue that has yet to be efficiently dealt with by the authorities since the time that relevant legislation on human trafficking was incorporated into the penal code in 2005, partially due to loopholes in the system. Therefore, alternatives have been sought so that persons dedicated to this business are punished and the crime not left unattended. This is especially important since the damage is not only to the victims but also to those that surround them. There has also been a need to analyze the public policy in Ecuador that addresses the prevention/protection of the victims and the sanctioning of the actors in the crime, in order to see the mechanisms used and the advances that have been made (if any) in the battle against human trafficking. Keeping in mind that Ecuador guarantees to society a respect of human rights. The study also highlights International Treaties that have been ratified by Ecuador and which focus on protecting victims from human trafficking in a very efficient way. However, as can be seen, our legislators have not paid much attention to the treaties, which is why our legislation on human trafficking is weak when it comes to sanctioning and creates at the same time creates confusion with other crimes that are somewhat related to human traffickingen
