| Descripción : | This paper contains a research about the application of the principle of exhaustion of trademark rights in Ecuador and its effects on international trade, specifically the conflicts arising from parallel imports of marked products. In order to have a clear idea of the exhaustion of trademark rights, we review the fundamental notions of marks, such as main characteristics and functions. Also spell out the rights and limitations arising from trademark registration in our country, based on standard intellectual property law, Decision 486 and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). With this information, we analyze the principle of exhaustion of trademark rights and parallel importations, from the perspective of the owner of trademark registration, consumer and enterprise. Concluding that Ecuador by applying the criterion of international trademark exhaustion does not solve the conflict generated by parallel importations, and must look for solutions that balance the interests of the parties involved and bring us closer to the implementation of a uniform standard in all the countries around the world, consistent with the global trend of market globalization. |
