dc.descriptionThis thesis analyzes those situations contemplated by the Andean Community normative and jurisprudence as exceptions of the territoriality principie, which is a fundamental basis of trademark rights. This analysis takes into special consideration the treatment of notoriety and well-known trademarks within our system, it also looks at the figure of Andean opposition, the principie of priority, and other linked institutions, such as the exhaustion of trademarks rights and the extraterritorial effect deriving from the use of the trademark. The thesis begins with a doctrinaire analysis of the figures concerned in order to study its treatment within the normative community, as well as the criteria adopted by the Andean Community Court of Justice when they are being interpretad. The emphasis has been on the study of those situations that have already been treated diversely by the jurisprudence and doctrine, and it simultaneously analyzes the coexistence of their application and even their permanence on our legislation trademark systemen
dc.description.abstractEn este trabajo de titulación se han analizado aquellas situaciones contempladas por la normativa y la jurisprudencia de la Comunidad Andina como excepciones al principio de territorialidad, uno de los pilares fundamentales del derecho marcario. Se ha tomado en cuenta en forma especial el tratamiento de las marcas notoriamente conocidas y de alto renombre en nuestro sistema, la figura de la oposición andina, el principio de prioridad y otras instituciones vinculadas, como el agotamiento del derecho de marca y los efectos extraterritoriales derivados del uso de la misma. Se parte del análisis doctrinario de las figuras en cuestión para posteriormente estudiar su tratamiento en la normativa comunitaria y los criterios adoptados por el Tribunal de Justicia de la Comunidad Andina al momento de su interpretación. Se ha hecho hincapié en el estudio de aquellas situaciones que han recibido un diverso tratamiento por parte de la jurisprudencia y la doctrina y se analiza la conveniencia de su aplicación e incluso de su permanencia en nuestro ordenamiento marcarioes_ES
