dc.descriptionTraditional knowledge represent the culture of common people all overthe world, TKs are people essence and carry thousands of years oftraditions and wisdom on them. Never the less, and despite the great value they have, the concern for their protection is resent.During the last decade, the scientific community has taken more interest in traditional knowledge of communities and nationalities all around the globe, people has full conscience of the input of TKs in matters of medicine and technologies and the advances in this areas thanks to them. In 1992 the Convention on Biological Diversity (CBD), emphasized the need of promoting and preserving traditional knowledge, being this agreement the basis for various inner legislations, for this establishes principles for access to genetic resources and traditional knowledge. In order to translate all the objectives planned and encouraging to determinate the need on the protection of TK, its important to approach for a complete definition of what TK is. This concept covers a countless ways of expressions. However, in a national point of view, TKs are all knowledge in hands of indigenous nationalities, afro, “montubio” and peasant communities, transmitted orally from generation to generation, and developed aside from traditional education. (De la Cruz, 2007; p.31)The ownership of TK is one of the most discussed themes: who posses them? And to whom must the benefit shearing go to? Likely, forums that concern about the value and importance of protection of TKs have been taken place in NGOs worldwide. The immediate results of the discussions that have taken place about TKs are a series of standard norms that have to be considered by Estates individually and as a group. Beside this, there is not clear for the international community the exact reason for protecting TK. Improving the way of living of indigenous communities as owners of TK and the prevention of biopiracy are two of the principal reasons for protecting this kind of knowledge. But, how can this knowledge be protected? The protection systems and mechanisms for traditional knowledge will be analyzed during this work. Mainly the sui generis system, known as the legal regime adapted to the nature and main characteristics of traditional knowledge, beneath the sphere of the Convention on Biological Diversity (CBD) and the Intellectual Property World Organization (WIPO).In like matter, Previous Consent and Disclosure of Origin by Certificates of Origin are two of the most suggested mechanisms for protecting traditional knowledge; they are the most effective and convenient way of approaching the objective of preservation. Moreover, particularly talking about Ecuador, national regulation, especially The Constitution and Intellectually Property Law, allow the protection of communal knowledge. Furthermore, Ecuador has submitted quite a few international treats about the subject that provide enough groundwork for the appliance of an Especial Law. Unfortunately, this purpose cant be accomplished due to the existence of legal obstacles. All along this work, what I pretend is to determinate the scope, systems and instruments applicable for Ecuador reality in matter of protection for TK, analyzing national and international laws, and the way alike countries have applied this provisions, so as to take them as basis for applicable rules nationallyen
dc.description.abstractLos conocimientos tradicionales representan la cultura de los pueblos alrededor del mundo, son su esencia y llevan miles de años de tradiciones y saberes incorporados en ellos. Sin embargo, y a pesar de la gran importancia de los mismos, la preocupación referente a la su protección es reciente. En los últimos años, la comunidad científica se ha interesado con mayor énfasis en los conocimientos tradicionales, pues se ha tomado conciencia del gran aporte que estos pueden hacer para los avances médicos y tecnológicos. En 1992 el Convenio de Diversidad Biológica (CDB) subrayó la necesidad de promover y conservar los conocimientos tradicionales, convirtiéndose éste en la base para varias legislaciones internas sobre el tema, pues en él se establecen los principios que rigen el acceso a los recursos genéticos y a los conocimientos tradicionales. Para poder plasmar todos los objetivos planteados es importante llegar a una definición de lo que son los conocimientos tradicionales. Este concepto abarca un sinnúmero de formas de expresión; sin embargo, a nivel nacional son todos aquellos saberes que poseen las nacionalidades y pueblos indígenas, comunidades afro, montubias y campesinas transmitidos de generación en generación, habitualmente de manera oral y desarrollados al margen del sistema de educación formal. (De la Cruz, 2007. p. 31) Uno de los temas más discutidos en cuanto a los conocimientos tradicionales tiene que ver con la titularidad de los mismos. Quién o quiénes son los poseedores de dicha información, y por lo mismo, a quiénes se les debe el pago por los beneficios obtenidos a través de la utilización de éstos. Igualmente, existe todavía falta de claridad respecto a la razón fundamental de protección. Entre las principales razones para la protección se encuentran el hecho de mejorar las vidas de los titulares de los Conocimientos Tradicionales, y la prevención de la biopiratería. Pero ¿cómo se puede proteger a estos conocimientos? Es ahí donde entran los sistemas y mecanismos de protección que serán analizados en este trabajo. Principalmente el sistema sui generis de protección.es_ES
