dc.descriptionThe new Constitution introduced new faculties and institutions. For example,the case of the article 148 of this Constitution, that it authorizes to the Presidentof the Republic to dissolve the National Assembly (Legislative Power), whenever in his opinion have been configured the reasons that this norm points out. The contradiction with the State of Right, Principle of Legality and Principle of Separation of Powers that it represents this power is due to diverse reasons: inapplicability of a figure of a parliamentary system in a presidential system as Ecuadorian, optional application gave to the President for the dissolution of Legislative, ignorance of the due process guaranteed by the same Constitution, legislation by order of the Boss of State. With this thesis, it will be demonstrated, by means of the analysis of the article 148 of the Constitution, of the applicable constitutional dispositions to the case, of the secondary legislation, doctrine and jurisprudence, that the interference of the Executive Power in the Legislative Power breaks a balanced system of properly defined functions. dc.description.abstractEl presente trabajo de titulación busca profundizar las dinámicas envolventes al mundo indígena en general, a través de sus luchas históricas que se convertirían luego en legislación internacional vinculante para varios estados, incluido el Ecuador, en donde existen 14 nacionalidades y 16 pueblos indígenas, entre ellos los pueblos indígenas en aislamiento, Tagaeri y Taromenane, quienes cuentan con un marco jurídico de protección que se analizará a lo largo del presente documento, con el fin de determinar si se cumplen o no las disposiciones internacionales y nacionales de garantía de los derechos humanos, y a la vez fundamentar la viabilidad del ejercicio de consulta previa.
